Agreement to Terms (EULA)

By accessing, downloading, installing, or using MoodJot (the "App"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, which constitute an End User License Agreement ("EULA"). You must explicitly agree to these Terms before using the App. If you do not agree to these Terms in their entirety, you may not access, download, install, or use the App. Your use of the App constitutes your acceptance of and agreement to be bound by these Terms.

Use License

Permission is granted to temporarily download one copy of MoodJot for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

Modify or copy the materials
Use the materials for any commercial purpose or for any public display
Attempt to reverse engineer, decompile, or disassemble the App
Remove any copyright or other proprietary notations from the materials

User Accounts

To use certain features of the App, you must register for an account. You agree to:

Provide accurate, current, and complete information during registration
Maintain and update your account information
Maintain the security of your account credentials
Accept responsibility for all activities that occur under your account

Premium Subscriptions

MoodJot offers premium subscription plans that provide access to additional features. By purchasing a subscription, you agree to:

Pay the subscription fee as displayed at the time of purchase
Automatic renewal unless cancelled before the renewal date
Subscription fees are non-refundable except as required by law
Cancel your subscription through your device's app store settings

User Content

You retain ownership of all content you create, upload, or share through the App ("User Content"). By using the App, you grant us a license to:

Store, process, and display your User Content to provide the App's services
Generate AI insights based on your mood data
Display your content on the public feed if you choose to share it (Premium feature)

You are solely responsible for your User Content and represent that you have all necessary rights to grant the license above.

User Conduct and Content Standards

MoodJot maintains a zero-tolerance policy for objectionable content and abusive users. We are committed to providing a safe, respectful, and positive environment for all users. By using the App, you agree to comply with the following standards:

You will not post, upload, share, or transmit any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable
You will not engage in any form of harassment, bullying, intimidation, or abuse directed at other users
You will not impersonate or attempt to impersonate another user, person, or entity
You will not use the App to spread misinformation, spam, or unsolicited communications

Violation of these standards will result in immediate termination of your account and access to the App, without notice or refund. We reserve the right to remove any objectionable content and take appropriate legal action against users who violate these Terms.

Prohibited Uses

You agree not to use the App:

In any way that violates any applicable law or regulation
To transmit any malicious code, viruses, or harmful materials
To impersonate or attempt to impersonate another user
To harass, abuse, or harm other users
To collect or harvest information about other users

Intellectual Property

The App and its original content, features, and functionality are owned by MoodJot and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Termination

We may terminate or suspend your account and access to the App immediately, without prior notice or refund, for any reason, including but not limited to:

Breach of these Terms, including posting objectionable content or engaging in abusive behavior
Violation of our zero-tolerance policy for objectionable content and abusive users
Any activity that threatens the safety, security, or integrity of the App or its users

Upon termination, your right to use the App will cease immediately, and we may delete your account and all associated data at our discretion.

Disclaimer

The App is provided "as is" and "as available" without any warranties of any kind. We do not guarantee that the App will be uninterrupted, secure, or error-free. The AI insights provided are for informational purposes only and should not be considered medical or professional advice.

Limitation of Liability

In no event shall MoodJot, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the App.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by updating the "Last Updated" date. Your continued use of the App after such changes constitutes acceptance of the new Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which MoodJot operates, without regard to its conflict of law provisions.
